BAD MAGIC PRODUCTIONS
ELIGIBILITY & REQUIREMENTS
Please be advised that you must meet the following eligibility requirements (which may be changed at any time by Producer in its sole discretion) (collectively, the “Eligibility Requirements”) in order to proceed with the ticket purchasing process and to participate in Producer’s event entitled “Bad Magic Gathering: Hot Wet Summer 2022” (the “Event”):
By purchasing a ticket, you agree to the following:
- You must be at least twenty-one (21) years of age.
- You must be legally present in the United States and be either a U.S. citizen or have a green card and unrestricted work visa, and have official legal documentation of same, including valid passport and driver’s license.
- You agree that each ticket you purchase is a license to attend a specific event and is subject to the additional terms printed on that ticket. You agree that you will not attempt to evade, avoid, or circumvent those additional terms in any manner with regard to any ticket purchased by you. Producer or its agents, affiliates, and authorized representatives reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct Producer or its agents, affiliates, or authorized representatives deem disorderly, who uses vulgar or abusive language or who fails to comply with Producer rules. Breach of terms or rules will terminate your license to attend the Event without refund. Producer or its agents, affiliates, and authorized representatives reserve the right to refuse admission for any other reason by issuing a refund to you for the ticket’s face value paid. A ticket is not redeemable for cash.
- To gain entry to the Event, you must consent to a search of you and your belongings and waive any related claims that may arise. If you elect not to give consent to such searches, you may be denied entry to the Event without refund or other compensation. Under certain venue rules, you agree that certain items may not be brought into the venue, including without limitation, glass bottles, aluminum bottles, knives, explosives, sling shots, weapons of any other kind, frisbees, flags, skateboards, roller skates, hover boards, laser pointers, drones of any kind, remote controlled devices or remote controlled toys, and other items as designated by Producer. You agree that any object considered to be a weapon will be confiscated prior to entry. Producer reserves the right to refuse admission to or eject any person, at Producer’s sole discretion, whose conduct is disorderly, disruptive, or who fails to follow the Event’s rules or directions, or whose language is vulgar or abusive.
- Producer reserves the right to change Event dates, times, venues and subject matter, which are listed on the ticket
- The foregoing eligibility requirements may be amended, revised or changed at any time and in any fashion in Producer’s sole discretion.
- If you do not receive a confirmation e-mail containing your electronic ticket after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with customer service whether or not your order has been placed. Producer will not be responsible for losses (monetary or otherwise) if you believe that an order was or was not placed because you failed to receive confirmation.
- The Producer reserves the right to cancel or postpone the Event. Cancelled and/or postponed events will, at the Producer’s sole discretion, be rescheduled within twelve (12) months of the date of the original event, or a refund or ticket exchange will be offered. In order to receive a refund or an exchange that may be offered, you agree to comply with the Producer’s instructions or deadlines. Producer will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled or postponed event
- You agree that unlawful resale of Producer tickets is grounds for seizure and cancellation without refund. You agree that a ticket shall not be used for commercial purposes, including, but not limited to advertising, promotions, contests or sweepstakes, unless the Producer gives prior written authorization of such use.
- You may bring personal, non-commercial, photography devices into the Event and may use these devices to obtain short-form video and still photographs (collectively “Personal Content”). By way of example, personal, non-commercial, photography and video devices include, but are not limited to, cell phones, small digital or film cameras (without a detachable lens). YOU MAY NOT MAKE ANY COMMERCIAL USE OF ANY PERSONAL CONTENT WITHOUT THE PRIOR WRITTEN PERMISSION OF PRODUCER. By way of example, commercial use may include, but is not limited to, posting Personal Content on a website that sells a product, or displays any ads or sponsored links; using or causing Personal Content to appear in any publication, magazine, serial, or book; using Personal Content to sell, sponsor, or endorse a product; or using Personal Content on any website that is or appears to be affiliated or associated with, or sponsored by the Event or the Producer. Producer reserves the right to prohibit any use of Personal Content which it believes is in violation of these terms. Producer in its sole discretion may determine what constitutes a commercial use not permitted by the terms.
- You acknowledge and agree that the service and any necessary software used in connection with the service (“Software”) may contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Venue Driver and/or its affiliates own the intellectual property rights to any and all protectable components of the Software and service, including but not limited to the name, logo and/or slogans of the service (trade names, trademarks, service marks), artwork and end-user interface elements contained within the service, many of the individual features, and the related documentation.
- You acknowledge that the following actions can get you removed from Event:
- Irresponsible or unsafe use of alcohol.
- Accessing restricted areas without proper credentials.
- Taunting, abusive or offensive language.
- Obscene or offensive gestures, including the use of obscene or offensive gestures through imagery or symbolism including banners, signs and other means of visual propaganda.
- Possession/use/sale of illegal drugs.
- Public urination or defecation (outside of a proper and/or public restroom).
- Fighting or engaging in any action that may harm, endanger, threaten or bring discomfort to anyone.
- Damage, destruction, vandalism or theft of any property.
- Participating in any activity that humiliates anyone or insults their human dignity.
- Fraudulently claiming a disability or abusing ADA services.
- Any individual who violates this code of conduct may be IMMEDIATELY removed from the Event and have their parking/camping privileges revoked, without refund. Law enforcement may be notified.
- All campers are expected to behave in a manner that is courteous to other campers. Producer is not responsible for any materials misplaced, lost or stolen. It is recommended that you do not bring valuable items. Do not leave valuable items in your tent. If you do not check-in together, you won’t be able to camp next to each other. Accommodations are assigned on a first-come, first-served basis. Arrive early to ensure your preferred location. There is no saving spots. Arrive together to camp together. Camping areas are open to visitation by and all Event attendees.
- You represent and warrant that all information you provide, including but not limited to all information concerning your name, address, credit card number, and other identifying information of any nature will be true, complete and correct, and that you will update all information as it changes. You agree that you will only use credit cards belonging to you to make a purchase. You further agree that you will not attempt to conceal your identity by using multiple Internet Protocol (“IP”) addresses or email addresses to use or make a purchase with the Service.
- No sponsorship, on site marketing, sampling, vending, coupon/product distribution, or other promotional/advertising activity may be conducted at the Event, absent the Producer’s prior written approval in each instance.
- You acknowledge that the Event ground is surrounded by private property and any ingress or egress upon such private party is prohibited unless otherwise approved by Producer. You will be solely responsible for any trespass upon adjacent property or injury thereto resulting from or in connection with your operations.
- You agree to indemnify and hold Producer, and each of their respective subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys’ fees, made by any third party due to or arising out of your use of the service, your connection to the service, your breach or violation of this terms of use, your violation of any rights of another, or your conduct at the Event.
- You understand and agree that there are certain risks of personal or property injury, illness and/or death associated with attending the Event, including, without limitation, risks related to the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”). You understand and agree (a) that the risk of exposure to COVID-19 cannot be fully eliminated and is increased by proximity to other people, (b) that an inherent and elevated risk of exposure to COVID-19 exists in any public place or place where people are gathered, (c) that attending the Event may involve coming into close contact with other people, (d) that there is no guarantee, express or implied, that You will not be exposed to COVID-19 and (e) that exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, and other short-term and long-term health effects, including death. Despite these risks, you voluntarily assume ALL known and potential risk and danger of injury and/or death from any cause, resulting from, in connection with, or incidental to the Event, including exposure to COVID-19. By purchasing a ticket, you expressly assume all risks and dangers arising from or incidental to the Event, whether such risks occur before, during, or after the Event and agrees that the Releasees (defined below) are not responsible for any such risks and dangers.
- You forever release, waive, discharge and agree not to sue the following: the Event owner(s); Event promoter(s); Event performers, artists and their managers, agents, furnishing companies and representatives; Producer, and Producer’s respective parents, subsidiaries, affiliates, partners, owners, members, managers, officers, directors, past and present employees, volunteers, agents, representatives, successors, trustees, successors and assigns (collectively, the “Releasees”) from any known or unknown claims, losses, damages, liability, demands, actions, injury or death, including those relating to COVID-19 or any other illness or injury that you may sustain while at the Event, regardless of whether caused by the negligence or other fault of the Releasees or any third party (collectively, “Claims” or, as used individually, a “Claim”).
- You consent to have medical treatment that may be deemed advisable in the event of an injury, accident, or illness during the Event and affirmatively releases the Event producer and all persons participating in such medical treatment from all responsibility for any such actions.
- By purchasing a ticket, you hereby acknowledge that, if you attend the Event, you may be filmed, videotaped and photographed, and your name, image, and likeness may be used in or to publicize the Event. By signing below, you hereby waive any rights of privacy or publicity in connection with the Event, agree not to assert any claim of any nature whatsoever (including any claims for injunctive relief and/or money damages), and certify that you meet the eligibility requirements and all of the information given by you is true.
